1. Acceptance of These Terms
These Terms of Use ("Terms") govern your use of Drop That! Digital Business Card ("Drop That!", "we", "us", or "our"), operated by Truly Bizzy Media.
By accessing or using Drop That!, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use the service.
2. About Drop That!
Drop That! provides tools that allow users to create, customize, manage and share digital business cards and related professional information.
Features may include public card links, QR codes, contact information, professional details, profile photos, logos, websites, locations, appointment links, event information, payment-service links and other features made available through the app.
3. Eligibility
You may use Drop That! only if you are legally permitted to enter into these Terms and use the service under the laws that apply to you.
If you use Drop That! on behalf of a business, organization or other entity, you represent that you have authority to accept these Terms on its behalf.
4. Accounts and Account Security
Some features may require you to create an account. You are responsible for providing accurate information and maintaining the confidentiality and security of your account credentials.
You are responsible for activity that occurs through your account unless unauthorized activity results from circumstances outside your reasonable control. If you believe your account has been compromised, contact us as soon as possible.
5. Your Digital Business Card
You control the information you choose to place on your Drop That! digital business card. You are responsible for the accuracy, legality and appropriateness of information you publish.
Because Drop That! is designed for sharing, information published to a public business card may be viewed by anyone who receives or accesses the card link or QR code. A recipient may also share that link or QR code with others.
Do not publish information that you do not want others to view or redistribute.
6. User Content
You retain ownership of content you submit to Drop That!, including photos, logos, business information, event content and other material you provide.
By submitting content to Drop That!, you grant us a limited, non-exclusive, worldwide license to host, store, process, reproduce and display that content only as reasonably necessary to operate, maintain and provide the service.
You represent that you own your submitted content or have the permissions necessary to use, upload and display it.
7. Acceptable Use
You agree not to use Drop That! to:
- Violate any applicable law or regulation
- Impersonate another person or falsely represent your identity or affiliation
- Upload content you do not have permission to use
- Publish unlawful, fraudulent, threatening, harassing or abusive content
- Distribute malware, malicious code or harmful software
- Attempt to gain unauthorized access to accounts, systems or data
- Interfere with the security, operation or availability of the service
- Use the service for spam, scams, phishing or deceptive activity
- Use another person's personal information unlawfully
- Reverse engineer or misuse the service except where applicable law expressly permits it
We may restrict or suspend access where reasonably necessary to protect users, the service or others from fraud, abuse, security threats or violations of these Terms.
8. Third-Party Links and Services
Drop That! may allow users to add links to third-party websites or services, including social platforms, appointment services, payment platforms, websites, maps and other external destinations.
Those third-party services are not controlled by Drop That! and are subject to their own terms, policies and practices. We are not responsible for content, transactions, availability or privacy practices of third-party services.
9. Payment Links Added by Users
Drop That! may allow users to display links to third-party payment services. Drop That! does not process payments sent through user-added payment links unless we specifically state otherwise.
Any payment, transfer, refund, dispute or transaction conducted through a third-party payment provider is between the parties involved and the applicable payment provider.
10. Purchases and Subscriptions
Certain Drop That! features may require a paid purchase or subscription. Pricing, billing frequency and included features will be displayed before purchase.
If you purchase through the Apple App Store, billing is processed by Apple through your Apple account. Your purchase and any renewal are also subject to Apple's applicable terms and billing policies.
If a subscription automatically renews, the renewal terms and price will be presented through the applicable purchase platform before you subscribe. You can manage or cancel an App Store subscription through your Apple account subscription settings.
Refund eligibility for App Store purchases is determined by Apple under its applicable policies.
11. Changes to Features and Availability
We may improve, modify, add, remove or discontinue features from time to time. We may also perform maintenance or updates that temporarily affect availability.
We do not guarantee that every feature will remain available indefinitely or that the service will operate without interruption.
12. Intellectual Property
Except for user content and third-party materials, Drop That!, including its software, branding, design, graphics, interface, text, logos and other original materials, is owned by or licensed to Truly Bizzy Media and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of Drop That! intellectual property to you.
13. Feedback
If you voluntarily send suggestions, ideas or feedback about Drop That!, you agree that we may use that feedback to improve or develop our products and services without an obligation to compensate you.
14. Account Suspension and Termination
You may stop using Drop That! at any time. You may also request account deletion through our Account Deletion page.
We may suspend or terminate access where reasonably necessary because of a material violation of these Terms, unlawful conduct, fraud, abuse, security risk or actions that may harm Drop That!, our users or third parties.
15. Disclaimer of Warranties
To the extent permitted by applicable law, Drop That! is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be uninterrupted, error-free, secure or compatible with every device, network or third-party service.
Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot lawfully be excluded.
16. Limitation of Liability
To the extent permitted by applicable law, Truly Bizzy Media will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use Drop That!, including losses resulting from third-party services, user-created content or information shared through public card links.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
17. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses or expenses arising from your unlawful use of Drop That!, your violation of these Terms, or content you submit in violation of another person's rights.
18. Privacy
Our collection and use of personal information is described in our Privacy Policy.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to Drop That!, our business practices or applicable requirements.
When we update these Terms, we will revise the "Last Updated" date above. Where appropriate, we may also provide additional notice of significant changes.
20. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
